Sukindi Terms and Conditions

These Terms and Conditions govern your access to and use of Sukindi, including the Sukindi homework app, Sukindi website, Sukindi Store, digital teaching resources, subscriptions, downloads, accounts, content and related services.
By accessing or using Sukindi, creating an account, purchasing a subscription, downloading a digital resource or using any related service, you agree to these Terms.

2. Definitions
Account means a registered account for accessing Sukindi, including an app account, store account, school account, home account or guest checkout account.
App means the Sukindi homework app and related homework, quiz, game, progress tracking and learning features.
Content means all materials provided through Sukindi, including text, quizzes, lessons, activities, images, audio, video, downloads, templates, worksheets, slides, unit plans, assessments, games, decodable readers and other teaching resources.
Digital Resource means a downloadable digital teaching resource purchased or accessed through the Sukindi Store.
Home Account means an account intended for individual or family use.
School Account means an account used by a school, education provider or organisation, including administrator-managed accounts.
Services means Sukindi products and services, including the App, website, Sukindi Store, Content, subscriptions, digital downloads, accounts, support and related services.
Store means the Sukindi Store, where users may purchase and download Digital Resources.
Subscription means a paid plan that provides access to paid app features for a billing period.
Trial means the free trial access period described in these Terms.
User means any person who accesses or uses Sukindi, including parents, teachers, school administrators, students, customers, store users and guest checkout users.
3. Eligibility and account registration
You must provide accurate and complete information when creating an Account, making a purchase or using Sukindi, and you must keep that information up to date.
You are responsible for all activity on your Account, including maintaining the security of your login details.
If you are under 18, you must have permission from a parent or guardian to use Sukindi, unless your School Account is provided through your school and the school has authorised your access.
If you create or manage a School Account, you confirm you have authority to do so for that school or organisation.
4. Guest checkout and store accounts
The Sukindi Store may allow guest checkout.
If you check out as a guest, a limited customer account may be automatically created so that your purchase, invoice and download access can be managed.
After purchase, you may receive an email link to access your Digital Resources. If you want to re-access your products later through your account, you may need to follow the email link and set a password.
You are responsible for ensuring the email address used at checkout is correct. If you enter an incorrect email address, contact us as soon as possible at hello@sukindi.com.au.
5. Licence and permitted use of Sukindi services
We grant you a limited, non-exclusive, non-transferable licence to access and use Sukindi and its Content in accordance with these Terms.
For Home Accounts, this licence is for personal and family use.
For School Accounts, this licence is for internal educational use by the authorised school, organisation and authorised users, subject to the plan, agreement or written arrangement that applies.
For Digital Resources purchased from the Sukindi Store, the licence terms in section 6 apply.
You must not:
Copy, reproduce, modify, distribute, sell, sublicense, publish, publicly display or commercially exploit Content unless these Terms expressly allow it or we have given you written permission.
Share paid access outside your household for Home Accounts.
Share paid access outside your organisation and authorised users for School Accounts.
Reverse engineer, interfere with, disrupt or bypass security or access controls.
Use Sukindi unlawfully or in a way that harms Sukindi, our users, our services or our reputation.
Use Sukindi Content to create competing products or services.
6. Digital Resource licence
When you purchase a Digital Resource from the Sukindi Store, you are purchasing a licence to use that resource. You are not purchasing ownership of the intellectual property in the resource.
Unless a product page or written agreement states otherwise, each Digital Resource purchase is licensed for use by one individual teacher only.
A single teacher may use the purchased resource with their own class or students.
The licensed teacher may:
Download and store the resource for their own teaching use.
Print copies for their own students.
Use the resource with their own class or students.
Display the resource to their own class or students as part of teaching.
Use the resource for their own classroom planning, instruction, assessment and related teaching activities.
The licensed teacher must not:
Share the digital files with other teachers.
Email, upload, publish or distribute the files to other staff members, schools, websites, shared drives, public platforms, social media groups or resource libraries.
Upload the files publicly or to any location where people outside the licensed teacher’s own class or students can access them.
Resell, sublicense, transfer, give away or commercially exploit the resource.
Distribute editable files.
Claim the resource as their own.
Use the resource to create a competing resource or product.
Remove Sukindi branding, copyright notices or ownership notices unless the resource is specifically designed to be edited for classroom use.
If another teacher wants to use the same Digital Resource with their own class or students, they must purchase their own copy unless a separate licence or written permission has been arranged.
7. Digital Resource delivery and access
Digital Resources are delivered by instant download from your account and/or by email link.
Access may depend on the availability of the Sukindi Store, email delivery systems, account access systems and third-party service providers.
You are responsible for downloading and saving your purchased resources in a safe location.
We may provide account-based re-access to purchased resources where reasonably available, but we do not guarantee that the Sukindi Store, account system or download links will be available forever.
If you cannot access a purchased resource, contact hello@sukindi.com.au and we will take reasonable steps to help.
8. Updates to Digital Resources
If a Digital Resource you purchased is updated, you may re-download the updated version for free while the updated resource remains available through the Sukindi Store and your purchase can be verified.
We may update Digital Resources from time to time to improve quality, correct errors, refresh design, adjust formatting or make other changes.
Purchasing a Digital Resource does not guarantee that updates will be made. Updates are provided at our discretion.
9. Curriculum and educational suitability
Sukindi resources are designed for educational use and may refer to curriculum codes, year levels, topics, learning areas or teaching sequences.
Where curriculum alignment is stated, we aim to make that alignment accurate and useful. However, teachers, schools, parents and users remain responsible for checking that each resource is suitable for their students, class, school, state, curriculum requirements, teaching context and assessment requirements.
Sukindi Content is not a substitute for professional teaching judgement.
10. User content and feedback
If Sukindi allows you to submit content, including text responses, uploads, feedback, survey responses or support messages, you grant us a worldwide, non-exclusive, royalty-free licence to use that content only to provide, operate, maintain, support and improve Sukindi.
You confirm that you have the right to submit anything you provide and that it does not infringe anyone else’s rights.
11. Availability, updates and changes
We may update, change, suspend or discontinue any part of Sukindi from time to time, including adding or removing features, products, resources, subscriptions, store functions or app features.
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you, for example by email, website notice, store notice or in-app notice.
Your continued use of Sukindi after changes take effect means you accept the updated Terms.
Subscriptions and billing
12. Free 7 day trial
We may offer a free 7 day trial for new Subscriptions.
The free trial is available once per Account only.
If you cancel and later resubscribe, reactivate or start another Subscription on the same Account, you will not receive another free trial.
At the end of the trial, unless you cancel before the trial ends, your Subscription will begin and you will be charged for the next billing period.
13. Subscription plans and pricing
We may offer different Subscription plans for Home Accounts and School Accounts.
We do not list fixed prices in these Terms because pricing may vary by plan type and may change from time to time.
The price and billing frequency applicable to you will be shown at sign-up, checkout or on your invoice.
Taxes may apply and will be shown where required.
14. Store pricing
Prices for Digital Resources are shown on the Sukindi Store product page or at checkout.
Prices may change from time to time.
Discounts, coupons, bundles, promotions or special offers may be offered, changed or withdrawn at our discretion.
A price change does not entitle you to a refund or credit for a previous purchase unless required by law.
15. Payment processing
For online payments, we use Stripe as our third-party payment processor.
Stripe may offer card payments or other payment methods depending on availability and configuration.
You authorise us and our payment processor to charge your chosen payment method for purchases, Subscriptions and any applicable taxes or fees.
We do not store full card details on our servers.
Your use of Stripe or any payment method offered through Stripe may also be subject to Stripe’s own terms, policies and security processes.
16. Automatic renewal
Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
You must ensure your payment method remains valid and up to date to avoid interruption to access.
We aim to present renewal terms and cancellation steps clearly at sign-up and in account settings.
17. Cancellation of Subscriptions
You can cancel your Subscription at any time through your account settings or by contacting support.
Unless required by law, cancellation takes effect at the end of your current billing period and you will retain access until then.
If you cancel during a free trial, your access will end when the trial ends and you will not be charged.
18. Invoiced subscriptions for schools and NDIS users
School administrators and NDIS users may contact us at hello@sukindi.com.au to request invoice-based arrangements or a dedicated billing option for app access.
Invoice arrangements may have different billing cycles, user limits and payment terms which will be set out in writing on the invoice or in a separate agreement.
Unless we agree otherwise in writing, invoiced subscription arrangements apply only to app access and not to standard Sukindi Store purchases.
If there is any inconsistency between these Terms and a signed written agreement for an invoiced plan, the written agreement will apply to the extent of the inconsistency.
Refunds and consumer rights
19. Refunds for Digital Resources
Due to the digital nature of downloadable products, change-of-mind refunds are not provided once files have been accessed, downloaded or delivered, except where required under Australian Consumer Law.
This includes situations where you purchased the wrong year level, changed your mind, no longer need the resource, found that the resource does not suit your preference, or failed to read the product description, unless we choose to provide a discretionary refund.
We may choose to provide a discretionary refund in limited circumstances, such as duplicate purchases, technical access issues that cannot reasonably be resolved, or other circumstances we consider appropriate.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under Australian Consumer Law.
20. Refunds for Subscriptions
If you change your mind, you are not automatically entitled to a refund under Australian Consumer Law consumer guarantees, although we may offer discretionary refunds in limited circumstances.
Unless required by law, Subscription cancellation takes effect at the end of your current billing period and fees already paid are not refunded.
Our Services come with consumer guarantees that cannot be excluded under Australian Consumer Law. For major failures with a service, you may be entitled to cancel your service contract and to a refund for the unused portion, or compensation for its reduced value, and for other reasonably foreseeable loss or damage.
Any refunds we provide will be processed using the original payment method where practicable.
Legal and responsibility
21. Privacy
Your use of Sukindi is also governed by our Privacy Policy. You should read it alongside these Terms.
22. Intellectual property
All intellectual property rights in Sukindi, the App, the Store, Digital Resources, Content, branding, characters, designs, files, templates, slides, worksheets, assessments, games, unit plans and related materials are owned by or licensed to Sukindi.
Except as expressly permitted in these Terms, you must not use our name, logos, characters, branding or Content without our written permission.
23. Third-party services and links
Sukindi may integrate with or link to third-party services, including payment processors, hosting providers, email providers, analytics tools, account systems and external websites.
We are not responsible for third-party services and your use of them may be subject to their own terms, privacy policies and conditions.
24. Disclaimers
Sukindi and its Content are provided for educational purposes and general information.
We do not guarantee that Sukindi will be uninterrupted, error-free, compatible with every device or suitable for your specific needs.
We do not guarantee that every Digital Resource will suit every school, student, class, teaching program, curriculum interpretation or assessment requirement.
You are responsible for checking suitability before relying on Sukindi Content in your teaching, learning, parenting or educational context.
25. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under law.
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, loss of data, loss of opportunity, loss of goodwill, business interruption, or loss arising from your use of or inability to use Sukindi.
Where liability cannot be excluded, our liability is limited, at our option and to the extent permitted by law, to resupplying the Services, replacing the relevant Digital Resource, providing an equivalent Digital Resource, or paying the cost of having the Services supplied again.
26. Suspension and termination
We may suspend or terminate your access to Sukindi if you breach these Terms, misuse the Services, infringe intellectual property rights, share paid content unlawfully, engage in fraudulent or harmful conduct, or if we are required to do so by law.
If we terminate or suspend access because of your breach, you may lose access to Content, progress, downloads, purchases or data associated with your Account, subject to applicable law.
27. Prohibited conduct
You must not:
Use Sukindi for unlawful purposes.
Misrepresent your identity, role, school, organisation or authority.
Share login details with unauthorised users.
Attempt to bypass payment, download, licence or access restrictions.
Upload harmful code or interfere with the operation of Sukindi.
Use Sukindi in a way that infringes intellectual property, privacy, confidentiality or other rights.
Use automated scraping, bulk downloading or extraction tools unless we have given written permission.
Distribute purchased Digital Resources outside the licence terms.
28. Governing law
These Terms are governed by the laws of Victoria, Australia.
You submit to the non-exclusive jurisdiction of the courts of Victoria.
